Terms & Conditions
The terms used herein have the following meaning:
Client – a natural person, legal person or organizational unit without legal personality but having legal capacity, placing an Order with the Online Shop;
Civil Code – Act of 23rd April 1964 (Polish Journal of Laws of 1964.16.93, as amended)
Terms & Conditions – these Regulations of providing services electronically via the Online Shop bookoff;
Online Shop (Shop) – Internet service available at http://www.bookoff.pl/, through which the Client may submit Orders;
Goods – products presented in the Online Shop;
Sales Contract – a sales contract of goods according to the Civil Code, concluded between bookoff and a Client through the Online Shop;
Consumer Rights Act – Act of 30th May 2014 on Consumer’ Rights (Polish Journal of Laws 2014, item 827);
Act on Providing Services by Electronic Means – Act of 18th July 2002 on providing services by electronic means (Polish Journal of Laws 2002, No.144, item 1204 as amended);
Order – statement of the will of the Client, aiming directly at the conclusion of the Sales Contract, specifying in particular the type and number of the Goods.
2. GENERAL PROVISIONS
These Terms & Conditions set out the rules for using the Online Shop available at: http://www.bookoff.pl/.
These Terms & Conditions are the regulations referred to in art.8 of the Act on providing services by electronic means.
The Online Shop bookoff, available at: http://www.bookoff.pl/, is operated by APM SALES AND SERVICES SP. Z O. O., Chmielna 73c/168, 00-801, Warszawa, NIP: 113 279 63 21, REGON: 142403216.
Entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Warsaw, XIII Commercial Division of the National Court Register under number 0000354351, with the share capital amounting to PLN 50 000,00.
These Terms & Conditions specify in particular:
- rules of registration and use of the account within the Online Shop;
- the terms and conditions for electronic ordering of products available through the Online Shop;
- rules for concluding Sales Contracts with the use of services provided within the Online Shop.
Use of the Online Shop is subject to the condition that the IT system used by the Client is to meet the following minimum technical requirements:

Firefox version 43 or later
MS Internet Explorer version 10 or later
Microsoft Edge version 13 or later
Opera version 36 or later
Safari version 4 or later
In order to use the Online Shop, the Client should have access to a computer terminal or Internet access terminal.
According to the valid legal regulations, bookoff reserves the right to limit the provision of services through the Online Shop to persons over the age of 18 years. In this case, potential Clients will be notified of the above.
Clients may access these Terms & Conditions at any time via the link on the main website http://www.bookoff.pl/, download it and print it.
Registration at the Online Shop is optional. The Client may place an Order without registering at the Shop, after accepting these Terms & Conditions. Registration is made by completing and accepting the registration form, available on one of the Shop pages.
In order to register, the Client has to agree to these Terms & Conditions and provide personal information indicated as obligatory.
bookoff may deprive Client of the right to use the Online Shop and may limit his access to some or all of the resources of the Online Shop, with immediate effect, in the event of Client’s breach of these Terms & Conditions, and in particular when Client:
- provides inaccurate or outdated information that is misleading or infringes the rights of third parties when registering in the Online Shop,
- has committed, through the Online Shop, infringement of personal rights of third parties, in particular the personal rights of other Clients of the Online Shop,
- behaves in other ways recognized by bookoff as inconsistent with applicable laws, general Internet usage rules or harmful for bookoff’s reputation.
In order to ensure the safety of the transmission of messages and data in connection with the services provided within the Site, the Online Shop shall take technical and organizational measures appropriate to the security risk of the services provided, in particular measures to prevent the unauthorized access and modification of personal data transmitted on the Internet.
The Client is obliged in particular to:
no distribution or transmission of content prohibited by law, such as content promoting violence, defamatory content or infringing personal and other rights of third parties, using the Online Shop in a way that does not interfere with its operation, in particular by using specific software or hardware, not taking action such as sending or posting unsolicited commercial information (spam) within the Online Shop, using the Online Shop in a way that is not harmful to other users or bookoff, using the content of the Online Shop only for personal use, using the Online Shop in a manner consistent with the law of the Republic of Poland, the provisions of these Terms & Conditions, as well as the general rules of using the Internet.
4. PROCEDURE FOR CONCLUSION OF THE SALES CONTRACT
In order to conclude the Sales Contract via the Online Shop, the Client should enter the website http://www.bookoff.pl/, select the product and take further technical steps based on the displayed messages and the information available on the website.
The selection of Goods ordered by the Client is made by adding them to the basket.
When placing an Order – until the button confirming that the Order has been placed is pressed – the Client has the possibility to modify the entered data and selected goods. For this purpose, the Client should follow the displayed messages and information available on the website.
After the Client using the Online Shop has given all the necessary data, a summary of the Order is displayed. A summary of the Order will include information on the object of the Order, total price as well as all the additional costs.
In order to send the Order, it is necessary to accept the content of these Terms & Conditions, to provide the personal information indicated as mandatory and to press the button that confirms placing an Order.
Information on the Goods given on the website of the Shop constitutes an offer within the meaning of art.66 of the Civil Code. Sending the Order by the Client is a statement of will to conclude with bookoff a Sales Contract, in accordance with these Terms & Conditions. The agreement is treated as concluded when the Client’s Order enters the IT system of the Online Shop, provided that the Order complies with the Terms & Conditions. After placing the Order, the Client receives an e-mail containing confirmation of all relevant elements of the Order.
The Sales Contract is concluded in Polish or English, with its content in accordance with Terms & Conditions, depending on the language chosen by the Client.
Delivery of Goods is limited to the territory of: Austria, Belgium, Czech Republic, Denmark (excluding Faroe Island and Greenland), Finland (excl. Aland Island), France (excl. Guadeloupe, Martinique, Guayana, Reunion, New Caledonia, French Polynesia, Wallis and Futuna, Mayotte, Saint-Martin, Saint Barthelemy, Saint-Pierre and Miquelon, French Southern and Antarctic Lands), Germany (excl. Island Helgoland and area of Busingen), Hungary, Italy (excl. Campione d'Italia, Livigno, San Marino, Vatican City), Poland, Portugal (excl. Madeira, Azores), Slovakia, Slovenia, Spain (excl. Canary Islands, Ceuta, Melilla), Sweden, The Netherlands (excl. Aruba, Curacao, Sint Marteen, Bonaire, Saba, Sint Eustatius), United Kingdom (excl. Jersey, Guernsey, Isle of Man, Anguila, Bermuda, British Antarctic Territory, British Indian Ocean Territories, British Virgin Islands, Falkland Islands, Gibraltar, Cayman Islands, Montserrat, Pitcairn Islands, St Helena, Ascension, Tristan de Cunha, Sovereign Base Areas of Akrotiri and Dhekelia, South Georgia and the South, Sandwich Islands, Turks and Caicos Islands) . The Goods are delivered to the address indicated by the Client while placing the Order. At the request of the Client, it is possible to deliver outside of the countries mentioned above with terms of delivery set individually.
Delivery of the Goods to the Client is paid for by the Client, unless the Sales Contract states otherwise. The costs of delivery (including transportation, delivery and postal services) are indicated on the website of the Shop, on the page “delivery” as well as at the time of placing the Order. Personal receipt of the Order is free of charge.
The exact delivery date depends on the country of destination and it is indicated to the Client on the website of the Online Shop, under the “delivery” tab. The delivery date is calculated from the moment the Client sends the Order. Realization of the Order starts after the Client places the Order (cash on delivery) or after the payment has been received (prepayment).
Clients can access these Terms & Conditions at any time via the link located on the homepage of http://www.bookoff.pl/, download it and print it.
Confirming, securing and making available to the Client significant provisions of the Sales Contract shall be made by sending to the e-mail address provided and including in the package, the Order Confirmation, Order Specification and invoice.
6. PRICES AND METHODS OF PAYMENT
Prices of the Goods are quoted in Polish zloty or euro, depending on the language version on the Shop chosen by the Client, and include all ingredients, including VAT (with the information of its rate), customs and all other costs.
The Client is able to pay the price:
- by bank transfer
- by cash on delivery (for the Goods delivered in Poland)
- by PayU
- by PayPal
- by payment system provided by IAI Inc
7. THE RIGHT TO WITHDRAW FROM THE CONTRACT
We would like to inform that according to the Consumer Rights Act from the 30th of May 2014 (Polish Journal of Laws 2014, item 827) every buyer can rescind the purchased goods within 14 days from the date of receipt of the goods.
8. COMPLAINTS ABOUT GOODS
bookoff as the seller is liable to the Client being a consumer within the meaning of art. 22 of the Civil Code, in respect for defects in the scope indicated by the Civil Code, in particular art. 556 and art. 556-556 of the Civil Code.
Complaints arising from the breach of the Client’s rights guaranteed by law or these Terms & Condtions, should be addressed to: APM SALES AND SERVICES SP. Z O. O., ul. Chmielna 73c/168, 00-801, Warszawa, email@example.com or through the account established in the Online Shop bookoff. bookoff undertakes to consider each complaint within 14 days and if it is not possible, Client shall be informed when the complaint will be processed.
bookoff is not a manufacturer of goods. Bookoff is not responsible for the guarantee of the goods sold. The manufacturer may be liable for the guarantee of the goods sold, under the terms and for the period indicated in the warrant card. If the guarantee document provides such an opportunity, the Client may claim his / her warranty claims directly at an authorized service center whose addess is included in the warranty card.
9. COMPLAINTS REGARDING THE PROVISIONS OF SERVICES BY ELECTRONIC MEANS
bookoff undertakes actions to ensure that the Shop is functioning properly to the extent that is based on current technical knowledge and undertakes to remove, within a reasonable time, any irregularities reported by the Clients.
The Client is obliged to immediately notify bookoff of any abnormalities or interruptions in the functioning of the Online Shop.
Abnormalities related to the functioning of the Shop, may be reported in writing to: APM SALES AND SERVICES SP. Z O. O., ul. Chmielna 73c/168, 00-801, Warszawa, firstname.lastname@example.org or by using the contact form.
In the complaint, the Client should give his name, address for correspondence, type and date of occurrence of anomalities related to the functioning of the Shop.
bookoff undertakes to consider each complaint within 14 days and if it is not possible, the Client shall be informed when the complaint will be processed.
10. FINAL PROVISIONS
Settlement of possible disputes arising between bookoff and the Client, who is a consumer within the meaning of art. 22 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the Civil Code.
Settlement of possible disputes arising between bookoff and a Client, who is not simultaneously a consumer within the meaning of art.22 of the Civil Code, shall be subject to the court of competent jurisdiction for the domicile of bookoff.
In matters not regulated in these Terms & Conditions, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
The Client has the right to use out-of-court complaint and redress procedures. In order to do so, the Client may file his complaint through the EU-based ODR website, available at: http://www.ec.europa.eu/consumers/odr.
